(A) The County Commissioners have determined that an emergency exists and that the highways and thoroughfares, primarily those composed of asphalt, are being destroyed by the current horseshoes being utilized by operators and owners of horse-drawn vehicles upon the roadways.
(B) As a result of the emergency and the authority granted to the County Commissioners pursuant to state law and, more specifically, the powers granted by I.C. 9-21-1-1 et seq., and the Home Rule provisions of the Indiana Code.
(C) The County Commissioners, after careful deliberation, discussion and meetings with the County Highway Department and discussions with leaders of the community heavily involved with horse-drawn vehicles, do hereby create and pass this subchapter to be known as the county “Horseshoe Ordinance”.
