§ 156.023 LOT SIZE AND SETBACKS.
   (A)   All proposed towers and any other proposed wireless telecommunications facility structures shall be set back from abutting parcels, recorded rights-of-way and road and street lines by the greater of the following distances: a distance equal to the height of the proposed wireless telecommunications facility structure plus 10% of the height of the facility or structure, or the existing setback requirement of the underlying zoning district.
       (1)   Notwithstanding the preceding, no tower shall be located nearer than 1,000 feet from a single-family residence, unless the county is provided with the written consent of any resident located closer than 1,000 feet from the proposed facility, showing agreement to a lesser setback.
      (2)   No habitable structures unrelated to the operation of the wireless telecommunications facility shall be permitted within the required setback.
   (B)   A tower that exceeds the maximum commercial height limitation shall further increase its setback 10% for each additional 50 feet over the maximum height.
      (1)   Notwithstanding the preceding, no tower shall be located nearer than 1,000 feet from a single-family residence, unless the county is provided with the written consent of any resident located closer than 1,000 feet from the proposed facility, showing agreement to a lesser setback.
      (2)   Towers shall be located at least 500 feet from either:
         (a)   The nearest paved public street maintained by a municipality or the NCDOT; or
         (b)   The nearest private street as identified and addressed under the county’s (or any other municipal) addressing ordinance.
