§ 50.42 DESIGNATION OF FACILITY SITE; EXCLUSIVITY.
   (A)   Designation. The county shall designate the facilities to be used for the disposal of solid waste collected within the service area. The county designates the following facilities for the disposal of solid waste collected within the designated geographic area:
      (1)   County landfill on Dalton Road (SR 1605); and
      (2)   Convenience centers owned or operated by, or on behalf of, the county when available.
   (B)   Exclusivity.
      (1)   All solid waste generated within the designated geographic area of the county and placed in the wastestream for disposal shall be transported to, and disposed of, exclusively at the designated facilities specified in division (A) above. No person shall dispose of any solid waste generated within the designated geographic area and placed in the wastestream for disposal, except at a designated facility. Any person disposing of solid waste generated within the designated geographic area and placed in the wastestream for disposal shall comply with the provisions of this chapter.
      (2)   Contracts for the disposal of solid waste at sites or facilities other than the county’s designated facilities which were entered into before the effective date of this chapter and which have an expiration date no later than December 31, 1994 shall be exempted from this requirement until expiration of such contracts or until December 31, 1994, whichever date is earlier.
