(A) The Davidson County Board of Commissioners may, on its own motion or petition, after public notice and hearing, amend, supplement, change or modify the watershed regulations as described herein.
(B) No action shall be taken until the proposal has been submitted to the Watershed Review Board for review and recommendations. If no recommendations has been received from the Watershed Review Board within 45 days after submission of the proposal, the Davidson County Board of Commissioners may proceed as though a favorable report had been received.
(C) Under no circumstances shall the Davidson County Board adopt such amendments, supplements or changes that would cause this chapter to violate the watershed protection rules as adopted by the N.C. Environmental Management Commission. All amendments must be filed with the N.C. Division of Environmental Management, N.C. Division of Environmental Health, and the N.C. Division of Community Assistance.
