(A) Each permit shall expire one year from the date of issuance and may be renewed only by making application as provided for in § 113.16. Application for renewal must be made at least 30 days before the expiration date. If the application for renewal is made less than 30 days before the expiration date, the application shall be treated as a new application. Provided, however, that during the pendency of the application, whether treated as a renewal or new application, and during any timely appeal before the Board of Commissioners, the permittee shall be allowed to continue operation of the adult establishment.
(B) In the event the County Manager denies renewal of a permit, the applicant shall be entitled to an appeals procedure as set forth in § 113.17(E). Provided, however, that during the pendency of any timely appeal before the Board of Commissioners, the permittee shall be allowed to continue operation of the adult establishment. If the County Manager's denial of permit renewal is upheld, or if not timely appealed by the applicant, the applicant shall not be issued a permit for one year from the date of the said denial. If subsequent to denial the County Manager finds that the basis for the denial of the renewal permit has been corrected or abated, the applicant may be granted a permit by the County Manager, and the County Manager shall have the discretion to deem the grant of the permit as a new permit or a renewal permit.
