§ 96.99 PENALTY.
   Notwithstanding any other remedies provided for in this chapter or otherwise available under law, the county shall have the power to impose a monetary penalty in the amount of $100 per day in the event the franchisee violates any provision of this chapter, the franchise, or any rule or regulation lawfully adopted thereunder. No civil penalty is to be imposed unless the franchisee is given reasonable written notice of its alleged violation and an opportunity to cure same within a reasonable time; no penalty is to be imposed without opportunity for the franchisee to be heard before the Board. Any person, whether natural or artificial, or commercial entities who violate the provisions of this chapter hereinbefore deemed lawful shall also be subject to those maximum criminal penalties as set forth in G.S. § 14-4.
