When a violation that constitutes an unsafe condition, as defined by § 98.005, the enforcement procedure in § 98.085(C) shall be followed, and civil penalties in accordance with a fee schedule listed in Appendix D of this chapter shall be assessed. When a violation is found to be a re-occurring violation as defined by § 98.005, the enforcement procedure in § 98.085(B) shall be followed.
