(A) The Scott Township Fire Protection Territory is hereby expanded and reestablished under the terms and conditions set forth in the interlocal agreement between the town, Scott Township, German Township and Armstrong Township, a true and accurate copy of which is attached to the ordinance codified in this subchapter as Exhibit “A,” and which is hereby incorporated by reference as if herein set out in full, and pursuant to the requirements of state law.
(B) The boundaries of the Scott Township Fire Protection Territory are and extend to the municipal boundaries of the town and to the boundaries of Scott Township, German Township and Armstrong Township.
(C) Scott Township is authorized to be the provider unit for the Scott Township Fire Protection Territory as that term is defined by state law.
(D) The town, German Township and Armstrong Township are authorized to be participating units with respect to the Scott Township Protection Territory as the term is defined by state law.
(E) The Scott Township Fire Protection Territory shall have a uniform rate upon all taxable property within the Territory for fire protection services.
(F) The town, German Township and Armstrong Township shall participate in both the annual budgeting and rate establishment process concerning the Scott Township Fire Protection Territory, as specified in the interlocal agreement. However, the town, German Township or Armstrong Township’s failure or refusal to participate in the annual budget and rate establishment process shall not deprive Scott Township of its right to proceed and to approve the annual budget and requisite tax rates.
(G) If either Scott Township, German Township, Armstrong Township or the town elects to withdraw from the Scott Township Fire Protection Territory, it must do so after January 1 but before April 1 in any given year and adopt an ordinance or resolution providing for the withdrawal of such unit effective on July 1 of the year in which the ordinance or resolution is enacted. If either Scott Township, German Township, Armstrong Township or the town enacts an ordinance or resolution withdrawing from the Scott Township Fire Protection Territory, the withdrawing unit’s maximum permissible ad valorem property tax levy, with respect to fire protection services, shall be initially increased by the amount of that particular unit’s previous year levy. Moreover, additional levy increases with respect to fire protection services shall be subject to the tax levy limitations under state law, except for the part of the unit’s levy that is necessary to retire the unit’s share of any debt incurred while the unit was a participating unit in the Scott Township Fire Protection Territory.
