§ 151.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   If, after the second site inspection as set out in § 151.06(E) of this chapter, continued noncompliance is determined, the Town Council will issue a noncompliance citation to the property owner. The civil penalty for the first citation will be in an amount as set by the Town Council from time to time. If the civil penalty for the first violation is paid to the town within 30 days from the date of the citation notice, the penalty will be in an amount as set by the Town Council from time to time. If the penalty is not paid to the town within 30 days, a lawsuit concerning the citation will be filed against the property owner in the County Superior Court (Small Claims Division), and any penalty imposed by the Court shall include court costs and a reasonable attorney fee.
      (2)   If, after the third site inspection as set out in § 151.06(G) of this chapter, continued noncompliance is determined, the Town Council will issue a second noncompliance citation to the property owner. The civil penalty for the second citation will be in an amount as set by the Town Council from time to time. If the penalty for the second violation is not paid to the town within 30 days from the date of the citation notice, a lawsuit concerning the citation will be filed against the property owner in the County Superior Court (Small Claims Division), and any penalty imposed by the Court shall include court costs and a reasonable attorney fee.
