§ 50.78 USE AND APPLICATION OF SERVICE DEPOSIT.
   (A)   All service deposits shall be maintained by the Controller as a separate fund to be applied or used only as herein set out.
   (B)   A customer’s service deposit may be applied by the electric utility to:
      (1)   All or a portion of any delinquent unpaid charges for electric service to that customer; or
      (2)   For damage to electric utility property caused by that customer or persons for whom the customer is otherwise legally responsible, such as the customer’s family or guests.
   (C)   The electric utility shall not pay interest upon any deposit.
   (D)   All or a portion of a deposit, upon determination of the Town Council after such time as the Council deems appropriate, may be refunded, provided all customers are treated on a uniform, non-discriminatory basis with respect to such refunds.
