If a customer shall validly give the electric utility the right to file a lien upon the serviced real estate in the event of nonpayment for the service, and agree to be responsible for the costs to the utility of filing such a lien, including reasonable attorney’s fee for the preparation of such lien and any county recorder’s fees, the service deposit may be waived, all at the discretion of the Controller.
