(A) There is hereby established, for the Town of Darlington, Indiana, a Department of Storm Water Management (“Department”). This Department is to be controlled by a board of directors consisting of 3 persons.
(B) The Town Council shall appoint all 3 directors, who may be members of the Town Council. The Town Council may remove a director at any time when, in the judgment of the Council, it is for the est interest of the Department. The terms of the directors shall be 3 years, and shall be staggered such that one term expires each year. A director may serve for an unlimited number of terms.
(C) A director is not entitled to a salary for serving as a member of the Board of Directors of the Department. However, a director shall be reimbursed for necessary expenses incurred by the director in the performance of official duties.
(D) The initial directors and their terms shall be:
(1) Kim Carpenter; term expires December 31, 2012.
(2) Mary Lou Weliever; term expires December 31, 2010.
(3) Charles Taylor, Jr.; term expires December 31, 2011.
(E) The Board of Directors shall have all the powers and duties set forth in I.C. 8-1.5-5 or its successor statute, if any, and such additional powers and duties as may be lawfully delegated to the Board from time to time by the Town Council.
