(A) Fire Protection Territory. In accordance with I.C. 36-8-19:
(1) The Town of Darlington, Indiana, is hereby authorized to become a party to 1 or more agreements for the establishment of the Darlington Fire Protection Territory (“the Territory”), a fire protection territory being hereby created pursuant to the statute.
(2) The boundaries of the Territory shall be those of Sugar Creek and Franklin Townships, including the Town of Darlington, all in Montgomery County, Indiana, and all adjacent to each other.
(3) Franklin Township shall be the “provider unit” responsible for providing the fire protection services within the Territory; Franklin Township is also a “participating unit”.
(4) The Town of Darlington and Sugar Creek Township shall be “participating units" in the Territory.
(5) The provider unit and the participating units hereby agree to and hereby adopt and impose a uniform tax rate upon all of the taxable property within the Territory for fire protection services to fund a Fire Territory Fund and an Equipment Replacement Fund as created herein. For purposes of complying with I.C. 36-8-19-6, 36-8-19-6-8 and 36-8-19-6-8.5, it is the intention of the town and townships that this section serve to create the Territory, and both Funds related to the Territory, and to set the tax levies and tax rates as provided in Ordinance 3-26-2015.
(B) Fire Territory Fund and Equipment Replacement Fund created.
(1) Pursuant to I.C. 36-8-19-8:
(a) There is hereby created a Fire Territory Fund from which all expenses for operating and maintaining fire protection services within the Territory, including repairs, fees, salaries, deprecation on all depreciable assets, rents, supplies, contingencies, and all other expenses lawfully incurred in or for the Territory shall be paid; and
(b) This Fund shall be funded and operate as set forth in I.C. 36-8-19-8.
(2) Pursuant to I.C. 36-8-19-8.5:
(a) There is hereby created an Equipment Replacement Fund to be used to purchase fire protection equipment, including housing, that will be used to serve the entire Territory; and
(b) This Fund shall be funded and operate as set forth in I.C. 36-8-19-8.5.
