§ 30.35  GENERALLY.
   The Clerk-Treasurer shall perform the duties of his or her office as provided by state law.
   (A)   He or she shall attend the meetings of the Council and shall keep an official record of its proceedings. He or she shall keep and preserve the papers of the town, receive all monies due and owing the town and shall make and execute all warrants disbursing the funds of the town. He or she shall make an accounting monthly to the Council of the financial condition of the town.
   (B)   The Clerk-Treasurer shall be the keeper of the official records of the town.
   (C)   The Clerk-Treasurer shall issue all licenses or permits provided for by this code and shall collect all license fees therefor, which shall be deposited to the general fund of the town.
   (D)   The Clerk-Treasurer shall receive compensation as is provided by ordinance of the Council, annually, as hereinafter provided and in addition thereto shall receive compensation as may be provided by the Council for his or her services on behalf of the town utilities.
   (E)   There is hereby established within the town the office of Deputy Clerk-Treasurer.
      (1)   The Deputy Clerk-Treasurer shall have all of the powers, duties and authority of the duly elected Clerk-Treasurer; however, the Deputy Clerk-Treasurer shall undertake and execute those duties only under the direction and control of the duly elected Clerk-Treasurer.
      (2)   The elected Clerk-Treasurer may, at his or her discretion, limit the duties and authorities of the Deputy Clerk-Treasurer but may not expand those duties and authorities beyond the scope of this section.
      (3)   The Deputy Clerk-Treasurer shall be appointed to that office by the duly elected Clerk-Treasurer and serve at the will and pleasure of the duly elected Clerk-Treasurer.
      (4)   If the appointed Deputy Clerk-Treasurer is otherwise an employee of the town, no fee or salary shall be paid for the performance of the duties of Deputy Clerk-Treasurer; however, if the Deputy Clerk-Treasurer shall not otherwise be an employee of the Town, the Town Council may, from time to time as it sees fit, fix a fee or salary for the services to be rendered by the Deputy Clerk-Treasurer. If a non-employee of the town is appointed as Deputy Clerk-Treasurer and there is not in effect an ordinance prescribing a salary or fee for the office, the Deputy Clerk-Treasurer shall assume his or her duties under the appointment without any right whatsoever to require the town to make payment for the Deputy Clerk-Treasurer duties, but assume the office at his or her own risk, as a volunteer.
      (5)   Before undertaking any duties or responsibilities as Deputy Clerk-Treasurer, the Deputy Clerk-Treasurer shall, at the expense of the town, file a fiduciary bond covering his or her activities as Deputy Clerk-Treasurer and the bond shall be in the like amount as that required of the duly elected Clerk-Treasurer.
