§ 30.20  GENERALLY.
   (A)   There is hereby created the office of Town Marshal. The Town Marshal shall be employed and appointed by the Council as provided by law. Upon the appointment of the Town Marshal, he or she shall be presented with a certificate and contract of terms of employment, which terms shall be those as may from time to time be negotiated between the Council and the Town Marshal, otherwise consistent with the powers and duties of a Town Marshal as provided by law. The Town Marshal shall be paid compensation as shall be determined by the Council annually, on or before December 31, to take and be in effect for the next succeeding calendar year. In the event of the resignation or other termination of the employment of the Town Marshal during the year, his or her salary shall be deemed payable on a monthly basis, shall be pro-rated to the end of the month during which the termination of employment occurs and he or she shall not be paid for any month in which no services are performed. The salary of the Town Marshal shall be in addition to any allowance for expenses included in his or her contract of employment.
   (B)   There is hereby created and established, within the department of and under the jurisdiction and control of the Town Marshal, Police Reserves.
   (C)   Each person appointed as a Police Reserve hereunder shall be an adult resident of the town.
   (D)   Each member of the Police Reserve shall be appointed by the Town Council, subscribe to an oath of office to faithfully perform his or her duties and be presented with a certificate of the appointment.
   (E)   The number of members of the Police Reserve shall be limited by the sole and exclusive discretion of the Town Council; further that, each member of the Police Reserve shall serve at the will and pleasure of the Town Council and may be terminated from the membership, without cause, by majority vote of the Town Council.
   (F)   While on official duty, Police Reserves shall have limited police powers at the discretion of the town. A Police Reserve shall be deemed to be on duty when he or she shall report to the office of the Town Marshal or another location as he or she may be directed by order of the Town Marshal or Council President and shall be deemed to remain on duty until released or discharged by the Town Marshal or the Council President. The call to duty or release therefrom may be either oral or written. When not on duty, the Police Reserves shall have no police powers, except those granted to citizens at large.
   (G)   As specific notice to all persons who may become members of the Police Reserves, they shall not, by reason of the office, be eligible to participate in any pension program provided for regular members of the Town Marshal’s office or department and shall serve in a Police Reserve capacity as a volunteer.
