(A) Notwithstanding any other provision of this code or rules adopted by the Park Board, no person shall use or possess alcoholic beverages or controlled substances within the town park, nor shall an intoxicated person or one under the influence of a controlled substance be permitted within the limits of the town park.
(B) The Town Marshal is hereby empowered to physically remove from the town park any person found to be therein in violation of this section and the Town Marshal is further empowered to confiscate and destroy any alcoholic beverage or controlled substance found upon the premises of the town park, unless the same is anticipated to be required to be used in evidence in any criminal proceeding involving the alcoholic beverage or controlled substance.
(C) The Board is hereby directed to post signs, at the places at the perimeter of or within the park as the Board deems appropriate, notifying the public that the use or possession of alcoholic beverages or controlled substances within the park is forbidden and if any such substances shall be found therein, the Town Marshal may confiscate and destroy the same.
