§ 92.06  REGULATION AGAINST BLOCKAGE OF PUBLIC WAY.
   (A)   It is hereby declared unlawful for any person to move any building upon or along any street, alley or public place within the town or to obstruct the streets and alleys of the town with any building or with any material of any kind without first obtaining a permit from the Clerk-Treasurer issued by him or her upon the authority of the Town Council.
   (B)   Any person who may obtain a permit under this or any other section of this code to obstruct the streets, alleys or public ways of the town with buildings or any other material or by the removal of any building of any kind whatever within the corporate limits of the town or who shall occupy with or without the permit any street, alley or public place, shall be liable to the town for all damages done to gas lines, hydrants, water pipes, electric lights, telephone or telegraph lines, shade trees or any other property belonging to the town or any citizen, company or corporation thereof or any other injury sustained by any person caused or directly or indirectly by the person by reason of his or her so using streets, alleys or public places.
   (C)   The permit above mentioned shall be based upon a formal petition or application addressed to the Town Council and filed with the Clerk-Treasurer at least 5 days prior to the meeting at which it shall be considered, at which time it shall be submitted to the Council by the Clerk-Treasurer for examination. The petition shall state distinctly the points from and to which the building shall be removed, the route proposed and name of streets to be passed over and no permit shall be granted or issued unless the petition or application be accompanied with a good and sufficient bond in double the amount of damages that might in any event occur to any private or public property, the bond to be approved by the Board.
   (D)   On issuing a removal permit or other permit the Clerk-Treasurer shall be entitled to demand and receive a fee of $5 as compensation to the town for its services in the several matters of filing and transmitting and the issuing of the permit.
   (E)   It shall be further unlawful for any person to make any unnecessary stoppage or delay upon any street or highway when removing any building and in no case shall the building be suffered to remain overnight over any fire cistern or water plug.
   (F)   Should any person injure any electric light, telegraph or telephone wire or wires or poles or any gas pipe or other pipe, shade tree or other property or any street or alley over or along which he or she may remove any building or cause the building to be removed he or she shall promptly repair the same and restore it to as good condition as it was before the injury.
   (G)   Any person violating this section or any other provisions hereof shall be subject to payment of a penalty to the town not exceeding $100.
