ORDINANCE NO. 7-2007

AN ORDINANCE CODIFYING AND COMPILING CERTAIN ORDINANCES OF THE TOWN OF DANVILLE INTO THE DANVILLE TOWN CODE

   WHEREAS, Indiana statutes empower and authorize municipalities to revise, amend, restate, codify and compile any existing ordinances and all new ordinances not heretofore adopted or published and to incorporate such ordinances into book form as a code of ordinances; and

   WHEREAS, the last time the general and permanent ordinances of the Town of Danville were revised, amended, restated, codified and compiled in book form was in 2005; and

   WHEREAS, the passage of general and permanent ordinances by the Town Council since the last codification in 2005 has created the need to update the Town's Code of Ordinances; and

   WHEREAS, the Town Council authorized American Legal Publishing Corporation to prepare the supplement to the Code of Ordinances; and

   WHEREAS, the Town has determined that the supplement to the Town's Code of Ordinances, prepared by American Legal Publishing Corporation, accurately and satisfactorily codifies and compiles the ordinances of the Town passed since the Code of Ordinances was adopted in 2005.

   NOW, THEREFORE BE IT ORDAINED by the Town Council of Danville, Indiana that:

Section 1.   The general ordinances of the Town of Danville as revised, amended, restated, codified and compiled in book form, know as the “Code of Ordinances of the Town of Danville, Indiana,” are hereby amended by the 2007 Supplement to the Code of Ordinances prepared by American Legal Publishing Corporation.

Section 2.   Such supplement to the Code of Ordinances shall be deemed published as of the day of its adoption and approval by the Town Council and the Clerk-Treasurer of the Town is hereby authorized and ordered to incorporate such supplement in Code of Ordinances in the Office of the Clerk-Treasurer.

Section 3.   Such supplement to the Code of Ordinances shall be in full force and effect as provided in Section 4, and Code with the supplement shall be presumptive evidence in all courts and places of the ordinances and all provisions, sections, penalties and regulations therein contained and of the date of passage, and that same is properly signed, attested, recorded and approved and that any public hearings and notices thereof as required by law for the ordinances contained have been given.

Section 4.   This Ordinance shall be in full force and effect immediately upon passage and adoption by the Danville Town Council.

   Adopted by the Town Council of the Town of Danville on this 21st day of May, 2007.
