(A) Fines. Any person violating this subchapter shall be punished by a fine of not less than $1,000 nor more than $5,000 for the first offense; and up to $10,000 for each subsequent offense. In addition to any fine imposed hereunder, the offender shall be ordered to pay the costs and fees incurred by the city in prosecuting the violation, which shall include but not be limited to the costs associated with an administrative adjudication proceeding or court proceeding and reasonable attorney fees.
(1) In the case of a minor, the parents or legal guardian shall be jointly and severally liable with the minor for payment of all fines and costs.
(2) In lieu of, or in addition to, the penalties described herein, a minor or adult may be required to perform community service.
(a) The minor or adult shall perform at least 30 hours of community service.
(b) If a minor is performing the community service, at least one parent or guardian of the minor shall be in attendance a minimum of 50% of the period of assigned community service.
(c) Reasonable efforts shall be made to assign the minor or adult to a type of community service that is reasonably expected to have the most rehabilitative effect on the minor or adult, including graffiti removal.
(B) Restitution. In addition to any penalty imposed herein, the offender shall be ordered to pay restitution to the victim for damages or loss caused directly or indirectly by the offender’s actions. In the case of a minor, the parents or legal guardian shall be jointly or severally liable with the minor to pay the restitution.
