(A) Upon receipt of the recommendations of the Directors referred to in § 127.06, the Mayor shall issue a license to maintain, operate, or conduct an adult use business unless he finds any one or more of the following:
(1) The applicant is under age of 21 years or under any legal disability.
(2) The applicant has held an interest in a license either under this chapter or Chapter 96 of this code which regulates alcoholic liquor and has been revoked for cause.
(3) The applicant, at the time of application for renewal of any license issued under this chapter, would not be eligible for the license upon a first application.
(4) The operation as proposed by the applicant, if permitted, would not have complied with all applicable laws, including, but not limited to, building, health, planning, housing, zoning, and fire codes of the city.
(5) The applicant provided false or misleading information on the application or renewal.
(6) The applicant has been convicted of a specified criminal activity. The fact that a conviction is being appealed shall have no effect under this subsection. For purpose of this subsection, the term "CONVICTION" means a conviction or guilty plea, and, includes a conviction of any business entity for which the applicant had, at the time of the offense leading to the conviction, a management responsibility or a controlling interest.
(7) The applicant is overdue in payment to the city of taxes, fees, fines or penalties assessed against or imposed upon him or her in relation to any business.
(B) Every adult use business license issued pursuant to this chapter shall expire on April 30 of each year.
(C) Any license issued pursuant to this chapter shall not be sold, given, transferred, or otherwise voluntarily or involuntarily alienated, conveyed or assigned to any other person or entity.
(D) Each applicant shall submit an application for renewal of the license no later than 30 days prior to the expiration of such license. The application for renewal shall be accompanied by the license fee. Failure to submit the application for renewal and license fee as set forth above shall result in automatic suspension of the applicant's current license until the application for renewal is approved and the license fee paid.
