(A) Any person found guilty of a violation of any of the provisions of this chapter shall be fined in an amount not less than $100 and not more than $500 for each offense or violation. Each day a violation continues shall constitute a separate offense. In addition to such fine, the offender shall pay to the city all costs and reasonable attorney’s fees incurred by the city in prosecution of such violation or violations.
(B) If any person makes retail sales as a transient merchant or itinerant vendor without having first obtained a license under this chapter, the police department may hold the inventory, vehicles or other personal property of the person until he or she obtains a license. If the property has been held for more than 60 days and the person whose property is being held has not obtained a license, the city may petition the circuit court for an order for the sale of the property being held. If the court finds that the person whose property is held has not obtained a license under this chapter, the court may order the police department to sell the property. Proceeds of the sale of the property less reimbursement to the police department for reasonable expenses of storage and sale of the property shall be deposited in the treasury of the city.
