(A) Any person found guilty of violating any provision of this chapter shall be fined not less than $100 nor more than $1,000 for each offense. In addition to any fine imposed under this chapter, the offender shall be ordered to pay all of the costs and fees incurred by the city in prosecuting the violation, which shall include but not be limited to the costs associated with an administrative adjudication proceeding or court proceeding, and reasonable attorney's fees.
(B) Auctioneers who are convicted more than once in a registration year for violations of this chapter may have their certificate of registration revoked or suspended. No such action shall be taken except after a 15-day notice sent to the auctioneer by first class mail. The notice shall state the reasons for any proposed action and shall establish the date, time and location of the hearing to provide the auctioneer with an opportunity to appear and defend against the proposed action. The hearing shall be conducted by a Hearing Officer within the city's administrative adjudication system. At the conclusion of the hearing, the Hearing Officer shall make the final decision whether or not to revoke or suspend the auctioneer's certificate of registration.
