§ 93.02 LICENSE, BOND AND GENERAL PERFORMANCE OF GARBAGE, SOLID WASTE, RUBBISH, AND SEWER/SEPTIC LIQUID WASTE COLLECTORS.
   (A)    Garbage, solid waste and refuse collectors.
      (1)   It shall be unlawful for any person to collect or haul garbage, solid waste or refuse for hire from any point in the City without first having obtained a license issued by the City. Such license shall be issued only upon proper application to the City Clerk, payment of a license fee of $150, proof of compliance with the insurance and bonding requirements for such license, and a copy of the state inspection report, certificate, or other proof of completion of the state inspection for any vehicle to be used within the City for such hauling. Any license issued pursuant to this subsection shall be renewed on May 1 of each year. At the time of renewal, the person shall provide a copy of the current state inspection report, certificate, or other proof of completion of the state inspection for any vehicle to be used within the City. Any license issued pursuant to this subsection may be revoked upon a violation of any of the provisions of this chapter, or of any state statute or ordinance of the City.
      (2)   All trucks used for the collection of garbage, solid waste and refuse must be of the packer-type or such other design suitable for sanitary and healthful transportation. The trucks shall be properly safeguarded to prevent leakage or spillage of or from the garbage, solid waste or refuse. Garbage, solid waste and refuse collection shall be done in a workmanlike manner and cause no nuisance or menace to public health or damage to any property. Trucks shall be provided with a legible company name in a conspicuous location allowing the identification of the equipment, owner or operator.
      (3)   The owner/operator of any truck, other than a packer-type truck, licensed under this subsection shall be required to cover such truck with a tarp or other covering to insure that no material being hauled by the truck drops from or blows off of the truck. The owner/operator of any trucks which is observed allowing garbage, solid waste or refuse to drop or blow off said trucks shall be responsible for picking up said garbage, solid waste or refuse from the public right-of-way or adjoining private property.
      (4)   Parking of garbage, solid waste or refuse collection trucks on public or private property so as to create a nuisance shall be prohibited.
      (5)   Prior to the issuance, or annual renewal of a license under this subsection, each person licensed shall furnish a bond in a form satisfactory to the City with a surety company licensed to do business in Illinois as surety conditioned on the observance of all ordinances of the City. The bond shall not be cancellable without 30 days prior written notice to the City, and shall be in an amount as follows:

   (B)    Rubbish and debris collectors.
      (1)   It shall be unlawful for any person to collect or haul rubbish or debris for hire from any point in the City without first having obtained a license issued by the City. Said license shall be issued only upon proper application to the City Clerk, payment of a license fee of $50 and proof of compliance with the insurance requirements for such license. Any license issued pursuant to this subsection shall be renewed on May 1 of each year. Any license issued pursuant to this subsection may be revoked upon a violation of any provisions of this chapter, or of any state statute or ordinance of the City.
      (2)   Vehicles operated by the licensee and licensed under this subsection shall be registered for a "D" license plate or a lower classification and shall be in good operating condition. Any trucks licensed pursuant to this subsection shall have the owner/operator name legibly printed in a conspicuous location allowing the identification of the equipment, owner or operator.
      (3)   The owner/operator of any truck licensed under this subsection shall be required to cover the truck with a tarp or other covering to insure that no material being hauled by the truck drops from or blows off of the truck. The owner/operator of any truck which is observed allowing rubbish or debris to drop or fall off said truck shall be responsible for picking up said rubbish or debris from the affected public right-of-way or adjoining private property. Collection of rubbish and debris shall be done in a workmanlike manner and cause no nuisance or menace to public health or damage to any property.
      (4)   Parking of trucks containing rubbish or debris on any public right-of-way, or in any other location which creates a nuisance, shall be prohibited.
   (C)   Sewer/septic liquid waste collectors.
      (1)   It shall be unlawful for any person to collect or haul sewer or septic liquid wastes for hire from any point in the City without first having obtained a license issued by the City. Said license shall be issued only upon proper application to the City Clerk, payment of a license fee of $150, proof of compliance with the insurance and bond requirements for such license, and a copy of the state inspection report, certificate, or other proof of completion of the state inspection for any vehicle used within the City for such hauling. Any license issued pursuant to this subsection shall be renewed on May 1 of each year. At the time of renewal, the person shall submit a copy of the current state inspection report, certificate, or other proof of completion of the state inspection for any vehicle to be used within the City. Any license issued pursuant to this subsection may be revoked upon a violation of any provisions of this chapter, or of any state statute or ordinance of the City.
      (2)   All trucks used for the collection or hauling of sewer or septic liquid wastes shall be of a design as to fully enclose and contain the wastes in a sanitary and healthful manner. The trucks shall be properly safeguarded to prevent leakage or spillage. Sewer or septic waste collection shall be done in a workmanlike manner and cause no nuisance or menace to public health or damage to any property. Trucks shall be provided with a legible company name in a conspicuous location allowing the identification of the equipment, owner or operator.
      (3)   Parking of sewer/septic liquid waste collection trucks on public or private property so as to create a nuisance shall be prohibited.
      (4)   Prior to the issuance or annual renewal of a license under this subsection, each person licensed shall furnish a bond in a form satisfactory to the City with a surety company licensed to do business in Illinois as surety conditioned on the observance of all ordinances of the City. The bond shall not be cancellable without 30 days written notice to the City, and shall be in an amount as set forth in subsection (A)(5).
   (D)   General requirements.
      (1)   All persons licensed under this section, on request of the City Clerk, shall furnish the names of the persons for whom they are doing work and the addresses where the work is being done. This information shall be on forms provided by the City Clerk.
      (2)   The license of any licensee failing to make the report within a reasonable time after being requested may be revoked by the Mayor.
      (3)   Each licensee must display the identification decal provided by the City Clerk in a location on each of the vehicles to be used pursuant to such license, as directed by the City Clerk.
