§ 52.10 DISPOSAL OF YARD WASTE.
   (A)   For purposes of this section, the term "YARD WASTE" shall mean: any natural debris or residue from trees, bushes, grass or other vegetation and includes but is not limited to grass clippings, leaves, tree and bush branches, bush trimmings, flowers, and landscape products.
   (B)   It is unlawful for any person, firm, corporation, or association to cause or permit any yard waste to be combined or commingled with household solid waste or other debris in the same bag or other container. It is unlawful for any person, firm, corporation or association to knowingly collect, gather, transport or deliver to or from any point within the City any yard waste which has been combined or commingled with household solid waste or other debris in the same bag or other container.
   (C)   No yard waste shall be collected for disposal within the City unless it shall be contained as follows:
      (1)   Within a City Toter or Other Toter and which bears a current valid yard-waste decal issued by the City. Decals shall be issued solely to solid waste customers of the City upon payment of the fee to be charged according to the Solid Waste Division Collection Fee Schedule, contained in Appendix A hereto.
      (2)   During the spring and fall seasons for periods determined by the City, within 30-gallon double ply bags issued or approved by the Public Works Director or his designee. During the periods described herein, no decal shall be required to be placed on the bags. If the bags are used in conjunction with a City Toter or Other Toter used for yard waste, the bags must be placed at least two feet away from such toter. The use of the bags shall be in compliance with the Public Works Solid Waste Division Rules and Regulations, including a 50 pound weight limit (copies of the Rules and Regulations are available at the Municipal Building and the Public Works Facility, as well as on the City's website).
   (D)   No branches, limbs or similar items exceeding two inches in diameter and four feet in length shall be combined or commingled with other yard waste, nor shall the same be collected unless the branches, limbs or other items are placed for collection in compliance with the Public Works Solid Waste Division Rules and Regulations (copies of which are available at the Municipal Building and Public Works Facility, as well as on the City's website).
   (E)   (1)   No yard waste shall be accepted by the City's landscape waste recycling facility except in bulk or in approved biodegradable bags. Fees for deposit of such yard waste at the facility shall be charged according to the volume of yard waste and as listed in the Solid Waste Division Collection Fee Schedule, contained in Appendix A hereto.
      (2)   Yard waste collected and deposited at the facility by the City or its agents shall be exempt from such fees.
