§ 50.18 USE OF GROUNDWATER AS A POTABLE WATER SUPPLY PROHIBITED.
   (A)   Definitions.
      “PERSON.” is any individual, partnership, co-partnership, firm, company, limited liability company, corporation, association, joint stock company, trust, estate, political subdivision including the city, or any other legal entity, or their legal representatives, agents, or assigns.
      “POTABLE WATER.” Any water used for human or domestic consumption, including but not limited to, water used for drinking, bathing, swimming, washing dishes, or preparing foods. The City obtains its water supply from Lake Vermilion located over one mile away from the areas affected by this section.
   (B)   Except for such uses or methods in existence before the effective date of this ordinance, the use or attempt to use by any person as a potable water supply groundwater from those portions of the following described areas that are within the corporate limits of the City by installation or drilling of wells or by any other method is hereby prohibited, including points of withdrawal by the City:
      (1)   Area 1. Bounded on the north by the CSX Transportation railroad track; on the east by the West Side of North Vermilion Street; on the west by the East Side of North Walnut Street; and, on the south by the North Side of West Williams Street.
      (2)   Area 2. Bounded on the north by the South Side of East Fairchild Street; on the east by the West Side of North Hazel Street; on the west by the East Side of North Vermilion Street; and, on the south by the North Side of East Woodbury Street.
      (3)   Area 3. Bounded on the north by the North Side of Williams Street; on the east by the West Side of North Jackson Street; on the south by the North Side of Madison Street; and on the west by the East Side of Franklin Street.
      (4)   Area 4. Bounded on the north by the South Side of Lape Street; on the east by the East Side of Fairweight Avenue and the East Side of Tennessee Avenue; on the south by the North Side of Nevada Avenue; and on the west by the East Side of South Virginia Avenue and the East Side of North Virginia Avenue.
      (5)    Area 5. Bounded on the north by the North side of Voorhees Street; on the east by the West side of Fowler Avenue; on the west side by the East side of James Street; and on the south by the North side of English Street.
      (6)   Area 6. Commencing at the southeast property corner of parcel number 23-09-328-010 (point of beginning), thence going west parallel to and along the southern property boundary of said parcel number 23-09-328-010 to the southwest corner of parcel 23-09-328-007, thence north along the west property boundary of 23-09-328-007 across south street to its north right-of-way line, thence east parallel to and along the north right-of-way line of south street to a point parallel with the eastern property boundary of parcel number 23-09-328-010, thence south parallel to and along the east property line of parcel number 23-09-328-010 to the point of beginning.
      (7)   Area 7. Beginning at the intersection of the east bank of the North Fork of the Vermilion River and a westerly extension of the north line of lot 100 of Carle at the Riverfront Subdivision as recorded as document number 21-06458 in the Vermilion County Recorder’s office, said north line also being the south right of-way line of Madison Street, thence east along said extension to the northwest corner of said lot 100; thence continuing east along the north line of said lot 100, and an easterly extension thereof, to an extension of the west right-of-way line of Gilbert Street; thence south along said west right-of-way line, and an extension thereof, to the north right-of-way line of U.S. Route 150 (Main Street); thence west along the north right-of-way line of U.S. Route 150 to the east bank of the North Fork of the Vermilion River; thence northwesterly along said east bank to the point of beginning, in the City of Danville, Vermilion County, Illinois.
