§ 50.13 BOATS AND BOATING.
   (A)   Boating shall be prohibited in that portion of Reservoir No. 2 within Zone A below a line extending from a sign so marked, located on the south shore of the reservoir at a point approximately 1,000 feet upstream from Dam No. 2 and at the entrance to Jewell Ravine to a similar sign located on the north shore of Reservoir No. 2 on a point of land at the first turn in the lake upstream from Dam No. 2. There shall be no restriction, however, upon representatives of the company or the board of health to prevent them from going by boat over any portion of Reservoir No. 2 for inspection, sanitary control, repairs, and all operations in connection with the maintenance of the water supply.
   (B)   No houseboats or boats on which the occupants remain more than a few hours shall be permitted on the reservoirs. No boats shall be equipped with toilet facilities for the storage or disposal of human excreta on or in the reservoirs. Persons operating a boat in these waters shall do so in a manner which will not create any unsanitary conditions in or about the waters or pollute the waters or make them unwholesome or unfit for use. No one shall throw or permit any slops, refuse, or other dirty or offensive matter or substances to be thrown into the waters.
   (C)   The board of health shall at all times have full power and authority to prohibit the use and operation of any and all boats in the waters should it become necessary, in the opinion of the board, to do so for the purpose of preventing, suppressing, or arresting any epidemic or contagious or infectious disease, or whenever, in the opinion of the board, it is necessary to preserve sanitary conditions. On written statement from the company that the use and operation of any or all boats should be discontinued for any reason having to do with the sanitary conditions or the safety of the users of boats, the board of health shall immediately prohibit the use and operation of any or all boats in the waters. In no event shall boats be permitted on the reservoirs, except upon the written permit issued by the board of health. The tributary watercourses shall be subject, at all times, to all rules and regulations established or to be established under the terms and provisions of this section.
   (D)   Application for permits provided for in this section shall be made in writing to the city clerk who shall, within 10 days, confer with the representatives of the company and the board of health and upon written approval of the company and board of health shall either issue or refuse the permit. Any applicant who has been refused a permit by the city clerk, as provided in this section, shall have the right to appear and make a direct application for a permit to the board of health at any regular meeting. The board of health shall issue or refuse a permit within 20 days after a hearing and a decision shall be final. In no case shall a permit be issued without the written approval of the company. The board of health may impose reasonable charges for permits issued under this section. ('64 Code, § 36-13)
