Before any vote is taken by the City Council on a proposed annexation, the annexation review process set forth below shall be completed; provided, however, the validity of an annexation ordinance passed by the City Council shall not be affected by a failure to follow or any deviations from the provisions thereof.
(A) A property owner or his agent meets with the Director of Public Development to discuss annexation and to obtain a petition.
(B) A completed annexation petition is filed with the City Clerk. A completed petition shall list the names of all the legal owners of the property, provide a legal description of the property, indicate what Township, School District and Fire Protection District the property is located in, and be signed by all legal owners of the property.
(C) The City Clerk ensures petition is complete and then forwards the petition to the applicable departments/individuals for review.
(D) The City Clerk sets the petition for public hearing before the City Council on a date within 60 days of the date of filing and also notifies Corporation Council to prepare annexation ordinance.
(E) Annexation review comments are returned to the City Clerk.
(F) The City Clerk sends out notices to affected taxing bodies at least 10 days prior to the public hearing.
(G) The annexation petition is placed on a Public Services or Public Works Committee agenda and the petition, staff comments, and ordinance are sent to Council members.
(H) After review by either the Public Services or Public Works Committee the petition is placed on the City Council agenda for public hearing and final action.
