§ 39.32 ADOPTION OF IML PROGRAM FOR THE DANVILLE DEPARTMENT OF PUBLIC TRANSPORTATION.
   (A)   The City hereby adopts by reference the Anti-Drug and Alcohol Misuse Policy, being FTA-IML Rev. 8.25.08. A copy of the policy shall be maintained in the office of both the Director of Public Transportation and the City’s Human Resources Manager.
   (B)   The City’s Program Administrator of the policy for all Department of Public Transportation employees to whom the policy applies shall be the Director of Public Transportation, or his or her authorized designee. The Program Administrator shall be responsible for the implementation and coordination of the policy and for the record-keeping requirements set forth in the policy and regulations.
   (C)   The Director of Public Transportation shall keep and maintain all required drug and alcohol test records for all employees in the Danville Department of Public Transportation to whom such Policy applies. Except as otherwise provided by the policy or regulations, the records shall be treated as confidential by the Director of Public Transportation. Records of insurance claims concerning rehabilitation treatment shall be treated as confidential by the Risk Manager. The Director of Public Transportation shall maintain a list of substance abuse professionals in the area who provide rehabilitation treatment services.
   (D)   Amendments.
      (1)   Delete text “(currently 10 percent)” after the word “alcohol” at the end of the first paragraph of Section 4(B) entitled Random Testing.
      (2)   Delete the text “(currently 50 percent)” after the word “testing” at the end of the first paragraph of Section 4(B) entitled Random Testing.
