§ 39.01 GENERAL POLICY.
   (A)   In the interest of providing to the citizens the highest quality of municipal service, the council declares as public policy the following personnel practices and procedures:
      (1)   There shall be no discrimination in original appointment or thereafter on the basis of sex, age, race, color, religion, national origin, sexual orientation, marital status, or physical or mental handicap unrelated to ability.
      (2)   There shall be maintained a uniform system of position classification and wage scale based upon the relative duties or responsibilities of a position in City service.
      (3)   There shall be established procedures for hiring, promotion, discipline, and discharge to insure a relationship which is fair and equitable for the employee and the City alike.
   (B)   All employees of the City shall be subject to the provisions of this chapter. However, in cases where the employee is a member of a recognized union, provisions of the written agreement between that union and the City shall apply if this chapter conflicts with those provisions.
