§ 30.09 INDEMNIFICATION OF CITY COUNCIL AND OFFICERS.
   Where the Mayor, the City Treasurer, City Council member, the City Clerk, and any appointed City officer has acted in his or her official capacity, the City shall indemnify such person who was or is a party or is threatened to be made a party to any threatened, pending, or completed action, suit, or proceeding by reason of the fact that the person is or was the Mayor, the City Treasurer, a City Council member, the City Clerk, or any appointed officer of the City. Under this indemnification, the City shall pay all expenses (including attorneys’ fees), judgments, fines, and amounts paid in settlement actually and reasonably incurred by the person in connection with such action, suit, or proceeding if he or she acted in good faith and in a manner he or she reasonably believed to be in the best interests of the City. Such indemnification by the City shall not apply to any criminal action or proceeding, unless the indemnified person is acquitted and had no reasonable cause to believe his conduct was unlawful. In the case of any such criminal action or proceeding, indemnification shall extend only to reimbursement of legal fees and related expenses actually incurred.
