(A) The false alarm fees for emergency alarms are as follows.
(1) Residential. After the sixth false alarm within a one-year period, the owner of the premises upon which the emergency alarm is installed will be charged a $10 fee for each false alarm received through the thirteenth. After the thirteenth false alarm within a one-year period, the owner of the premises upon which the emergency alarm is installed will be charged $25 for each false alarm.
(2) Commercial/retail/industrial. False alarms will be charged at the rate of $25 per false alarm after the sixth false alarm call within a one-year period. After the thirteenth false alarm within a one-year period, the owner of the premises upon which the emergency alarm is installed will be charged $50 for each false alarm.
(B) Penalties provided for false alarms that are relayed or transmitted through any means to the Police Department shall be the responsibility of the owner of the premises upon which the emergency alarm system is installed. Any charge for a false alarm, as provided for by division (A) above, which remains unpaid for 45 days after invoicing shall accrue a late fee to be assessed at $2 per day, beginning 46 days after invoicing and continuing until the invoice and late fees are paid.
(C) The owner of the premises upon which an emergency alarm is used shall, as a condition to installation and continued operation of the equipment or service, execute a consent in the forms as may be prescribed by the Police Department that the owner shall pay the village for false alarms upon the posted schedule for each false alarm as set forth herein.
(D) The owner, lessee or user of any emergency alarm system subject to this chapter shall execute a waiver, approved by the village, of the right to bring or file any action, claim or complaint whatsoever against any police personnel who makes a forced entry into the subject premises in response to an alarm.
