§ 52.34 RIGHT OF ENTRY; LIABILITY DURING INSPECTIONS.
   (A)   Any duly authorized employee or agent of the village bearing proper credentials and identification shall be permitted at any time to enter upon all properties within the jurisdiction of the village for the purpose of inspecting, observing, measuring, sampling and testing, as may be required in pursuance of the implementation and enforcement of the terms and provisions of this subchapter.
   (B)   While performing the necessary work on private properties referred to in division (A) above, the duly authorized employees of the village shall observe all safety rules applicable to the premises established by the commercial or industrial user, and the user shall be held harmless for injury or death to the village employees, and the village shall indemnify the user against loss or damage to its property by village employees and against liability claims and demands for personal injury or property damage asserted against the user and growing out of the gauging and sampling operation, except as such may be caused by negligence or failure of the user to maintain safe conditions.
