3-6-12: PROHIBITED CONDUCT, ENFORCEMENT, AND PENALTIES:
Should the city, at any time during the period in which a home based business is in operation, receive a written complaint, and after conducting an investigation, find that the operation of such home based business is in violation of the provisions of this chapter and/or the terms and conditions subject thereto, the city shall serve notice, by certified mail, to cease activities conducted in violation of the home based business regulations. Such notice shall be headed "NOTICE TO CEASE NON-PERMITTED HOME BASED BUSINESS ACTIVITY", shall contain a description of the property, shall describe the ordinance section(s) violated, shall specify the penalty provisions of this chapter, and shall specify the appeal process specified by this chapter.
The property owner or resident shall stop all work associated with the permit until authorized by the city to proceed. The city may also withhold further issuance of permits.
Violations of this chapter may be considered a criminal misdemeanor and shall be punishable by a maximum fine of three hundred dollars ($300.00) or six (6) months in jail, or both. Each day of violation shall constitute a separate offense. The city may also take civil action to compel compliance of requirements or performance and completion of, or maintenance of, improvements installed pursuant to this chapter. (Ord. 180, 12-1-2005)
