§ 132.06 ENFORCEMENT.
   (A)   First offense.
      (1)   Before taking any enforcement action under this chapter, a police officer shall ask the apparent offender’s age and reason for being in the public place or establishment during restricted hours.
      (2)   The police officer shall not prepare a juvenile arrest report, issue a citation or make an arrest under this chapter unless the officer reasonably believes that an offense has occurred and that, based on any response and other circumstance, no exception or defense in §§ 132.04 or 132.05 is present.
      (3)   The police officer shall escort the juvenile home to his or her parent or guardian. The police officer will inform the parent/guardian in writing of the acknowledging that they understand the ordinance and agree to abide by the ordinance. The minor will then be released to the custody of the parent/guardian.
   (B)   Second offense.
      (1)   Before taking any enforcement action under this chapter a police officer shall ask the apparent offender’s age and reason for being in the public place or establishment during restricted hours.
      (2)   The police officer will ascertain whether this is a second offense of this chapter by the juvenile.
      (3)   The juvenile will be transported to the Police Department and held until the parents or guardians can be notified to pick up the juvenile.
