§ 34.07 AUTHORIZING DESIGNATION OF POLICE OFFICER AS AGENT OF OWNERS AND TENANTS TO ENFORCE “NO TRESPASSING” REGULATIONS ON PRIVATE PROPERTY.
   The present and future members of the Town Police Department (including auxiliary police officers), be and they are hereby authorized to act as agents for the property owners and tenants, to enforce regulations against trespassing on private property located within the corporate limits of the town, upon specific request by the property owners or tenants, in accordance with the terms of the agency agreement hereto attached. This section may be repealed at any time by the Board of Aldermen without notice to any of the parties involved.

The undersigned hereby authorizes the DALLAS Police Department, and all of its present and future Police Officers (including Auxiliary Police Officers) to act as agent for the undersigned in ordering any individual(s) or group(s) of individuals to leave the above premises (property as described in Deed Book _______ at Page _____________________) during non-business or otherwise designated hours. It is further understood that the police officer(s), in his or her exclusive judgment, deem it necessary and that if the person(s) does not leave, the police officer(s) may arrest the person(s) for violation of G.S. § 14-134 (trespass) or other appropriate statutes that the police officer(s) may deem applicable to a particular situation.
The undersigned or undersigned’s designated representative, agrees to sign a complaint under G.S. § 14-134 if called upon to, and to testify in court, if called upon to, that the undersigned or undersigned’s designated representative requested the DALLAS Police Department to order individual(s) or group(s) of individuals to leave the above named premises during non-business or otherwise designated hours.
At the expense of the undersigned, a permanent sign of at least 18 inches by 24 inches shall be erected before the below effective date. The sign shall state “No Trespassing (state time and days); Police Authorized to Arrest Under G.S. § 14-134”.
This agreement shall take effect on the ________ day of _______________, 20____, and shall remain in force until either the undersigned or the DALLAS Police Department terminate and revoke without assignment of reason, and without any particular notice period being required of the party wishing to revoke, so long as notice of the revocation is delivered in writing to the other party.
