(a) Subject to the provisions of Sections 254.081 through 254.083, and after the first six days of service-related disabilities as set forth in Section 254.081 through 254.083, the sick leave credits of an employee who is injured during the performance of his or her duties within the scope of his or her employment shall not be reduced for any period of time that he or she is absent from work because of such service-connected injury. "Injury" means physical damage resulting from an accident, and also includes heart attacks or failures, strokes or physical or mental illnesses or diseases, if the employee furnishes a certificate from a physician that such injury is service-connected.
(b) In the event of a dispute as to whether an injury is service-connected within the meaning of this section or whether an injury is deemed to have resulted from hazardous or nonhazardous duties pursuant to Sections 254.081 or 254.082, such dispute shall be submitted to a Board of Appeals, consisting of the Mayor and two members of Council to be selected by Council. If the injured person is a member of the Fire Department, such Board shall be increased to include two members of the Fire Department to be selected by the remaining members of the Fire Department. If the injured person is a Police officer, such Board shall be increased to include two police officers to be selected by the remaining officers of the Police Department. If the injured person is a member of the Service Department, such Board shall be increased to include two Service Department employees to be selected by the remaining members of the Service Department. If the injured person is a member of the Public Employees Retirement System receiving sick leave credits pursuant to Section 254.07(b), such Board shall be increased to include two members of the Public Employees Retirement system receiving sick leave credits pursuant to Section 254.07(b), to be selected by the remaining members of the Public Employees Retirement System receiving sick leave credits pursuant to Section 254.07(b). The decision of the Board shall be final and conclusive.
