2.44.010   Park, Recreation and Forestry Committee.
   The purpose of the park, recreation and forestry committee shall be to serve as an advisory committee to assist in planning, establishing, improvement, upkeep, regulation and management of a system of public parks and parkways, and to facilitate a system of public recreation and playgrounds in and for the City of Custer. The park and recreation committee shall also serve as the city tree board in accordance with chapter 12.14, City Trees and Forest. The Custer City Common Council shall exercise all powers and duties of a Park and Recreation Board per SDCL 9-38-7 and 9-38-80, as determined to be in the best interest of the municipality. The park, recreation and forestry committee shall be governed by the following rules and regulations:
   A.   Composition. The voting portion of the park, recreation and forestry committee shall be composed of eight members; two of whom shall be residents of the city, one of whom shall reside outside the city limits but within the extraterritorial platting jurisdiction of the city, one whom shall be a representative of the Custer YMCA, one whom shall be a representative of the Mile Hi Garden Club, one whom shall be a representative of Custer State Park, one whom shall be a representative of the Custer County Conservation District and one whom shall be a non-voting liaison from the Custer City Council.
   B.   Members not Elected Officer. The voting members of the park, recreation and forestry committee shall not hold any elective office in the government of the City of Custer.
   C.   Appointment. The members of the park, recreation and forestry committee shall be appointed by the mayor with the approval of the common council of the city, at its second regular meeting in July of each year, and as necessary or needed.
   D.   Officers. At the regular meeting of the park, recreation and forestry committee in August of each year, the committee shall elect from its voting members a chairperson and a vice-chairperson, each of whom shall serve until the meeting of the committee in August of the following year. The vice-chairperson shall act in the absence or disability of the chairperson. In event the chairperson is unable to continue serving on the committee, a successor shall be elected at the committee's next meeting.
   E.   Meetings. The park, recreation, and forestry committee shall hold regular meetings at least once each quarter, and as many special meetings as it deems proper.
   F.   Quorum. Three voting members of the park, recreation and forestry committee shall constitute a quorum for the transaction of business.
   G.   Affirmative Action. An affirmative vote of at least three members of the park, recreation and forestry committee shall be necessary to authorize any action of the committee.
   H.   Records—Reports. The secretary of the park, recreation and forestry committee shall be a city staff person in attendance, who shall keep a record of its proceedings and make such reports as may be required by the committee. In the absence or inability of the secretary to act, the committee may appoint a secretary pro tern to perform his or her duties. The records of the committee kept by its secretary or copies of any such records, when duly certified by the secretary, shall be competent evidence of the proceedings of the committee.
   I.   Powers and Duties Generally—Limitations. The park and recreation committee shall serve as a recommending committee to Council. Whenever approval of the common council of the city is required, such approval shall be obtained.
   J.   Budgeted Funds. The City shall set aside $50,000 of annual spending funds within the general fund budget to be used by the City, taking into consideration the recommendations of the park, recreation and forestry committee.
