The builder or contractor shall restore the street or alley to good usable condition, acceptable to the Custer City public works supervisor or forfeit the street cutting bond. In the event that the builder or contractor shall forfeit the bond and that the bond is not large enough to cover the cost of the street restoration, the builder or contractor shall pay the city the difference between the amount of the deposit and the cost of the street restoration. When the city public works supervisor has accepted the restoration of the street or alley and signed a release, the city finance office shall refund the deposit to the builder or contractor.
