A. Any person who: (1) is an inmate of a house of prostitution or otherwise engages in sexual activity for a fee; or (2) loiters in or within view of any public place with the purpose of being hired to engage in sexual activity is guilty of prostitution.
B. A violation of this section is a Class II misdemeanor and subject to the penalties therefor as set forth in Chapter 1.12 of this code.
