A. It is unlawful for any person to assemble with two or more persons for the purpose of engaging in conduct constituting a riot or an aggravated riot. It is further unlawful for any person present at an assembly that either has or develops such a purpose to remain therewith and to advance that purpose.
B. A violation of this section is a Class II misdemeanor and subject to the penalties therefor as set forth in Chapter 1.12 of this code.
