(A) Any person found to be violating any provisions of this chapter, except §§ 50.05 and 50.06, shall be served by the town with written notice stating the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof. The offender shall, within the period of time stated in the notice, permanently cease all violations.
(B) For any violation of § 50.05(D)(1) and (E), including the failure to adhere to any directives or orders issued by the town or its agents, the following penalties are established:
(1) For a first offense, a fine of $100 shall be assessed, the same to be paid within 48 hours of the receipt of the written assessment of fine;
(2) For a second offense, a fine of $500 shall be assessed, the same to be paid within 48 hours of the receipt of the written assessment of fine; and
(3) For a third and subsequent offense, a fine of $2,500 per occurrence shall be assessed, the same to be paid within 48 hours of the receipt of the written assessment of fine.
(C) Any person who shall continue any violation beyond the time limit provided for in division (A) above shall be guilty of a misdemeanor, and upon conviction thereof, shall be fined in an amount not exceeding $10 for each violation. Each day in which any violation shall continue shall be deemed a separate offense.
(D) Any person violating any of the provisions of this chapter shall become liable to the town for any expense, loss or damage occasioned by the town by reason of the violation.
