THIS AGREEMENT, made and entered into this__________day of__________,________, by and between___________________________hereinafter designated as Owner and the Town of Culver herein represented by the Town Council.
WITNESSETH;
WHEREAS, the Owner has subdivided lots________________through_______________Subdivision and has received approval and acceptance from the Town of Culver for subdivision improvements constructed therein; and
WHEREAS, under the provisions of Subparagraph_____of Section_____of the Subdivision Control Ordinance, the Owner is required to maintain certain improvements for a period of______________________;
NOW THEREFORE, it is hereby agreed by and between the Owner and the Town Council that the Owner hereby agrees that he or she will keep all fill trenches, pipes, manhole structures and paved or unpaved surfaces constructed by him or her in_____________________Subdivision and will make such repairs to any defect in materials or workmanship as may develop or be discovered when called upon to do so by the Town.
It is agreed that this Agreement shall be in full force and effect for a period of______________years from______to__________.
