§ 151.083 SANITARY SEWAGE SYSTEM.
   (A)   (1)   A subdivision plat shall not be considered for final approval until the construction plans for the sewage system have been submitted to and approved by the Town Council.
      (2)   Sanitary sewer disposal systems should be designed for the ultimate tributary population. Due consideration should be given to current zoning regulations and approved planning reports. Sewer capacities should be adequate to handle the anticipated maximum hourly quantity of sewage together with allowance for infiltration and other extraneous flow.
   (B)   (1)   A sanitary sewer system shall be designed and constructed by the subdivider. Sewers shall be installed to serve all lots to grade and size required by the town. All plans shall be in accordance with local regulations and are subject to specific written approval from the Town Council prior to the start of construction. The approval shall be by the affixing of the Council's signature on the cover sheet of the final construction prints.
      (2)   It shall be required that each developer provide two copies of as-built prints to the town no later than six months after completion of the construction. The as-built prints shall be certified to be correct by the engineer.
      (3)   A permanent sanitary sewage collection system including all pipes and manholes shall be provided and the collection system shall be connected (extended to connect, if necessary) with an existing public sanitary sewage system when available.
      (4)   The diameter of sewers proposed shall not exceed the diameter of the existing or proposed outlet. All sewers shall be laid out in straight alignment between manholes. Manholes shall be installed at the end of each line, at all changes in grade, size or alignment, at all intersections and at distances not greater than 400 feet for sewers 15 inches or smaller, and 500 feet for sewers 18 inches or larger in diameter.
      (5)   A minimum horizontal distance of ten feet shall be maintained between parallel water and sewer lines. At points where sewers cross water mains, the sewer shall be constructed of cast iron or encased in concrete for a distance of ten feet in each direction from the crossing measured perpendicular to the water line. This will not be required when the water main is at least two feet above the sewer.
   (C)   (1)   A minor subdivision shall be required to connect to the municipal system if it is within 200 feet of an available, adequate, connecting point.
      (2)   A major subdivision shall be required to connect to the municipal system if it is within 500 feet of an available, adequate, connecting point.
   (D)   (1)   In the event an area proposed to be platted is not so located as to permit connection into the municipal sewerage system a private sewage disposal system for each lot shall be designed in accordance with the minimum requirements of the County Health Department and in accordance with all rules and regulations set forth by the State Board of Health.
      (2)   In no case will any part of the private system, including seepage field or leaching field, be located closer than ten feet to a property line or within 75 feet of a private well. (See Chapter 152 for special requirements which apply to Lake District.)
      (3)   If individual septic systems are proposed for the subdivision, it shall be required that a percolation test is done for each and every proposed lot in the subdivision. Certification of test results on each proposed lot shall be submitted with the request for approval of the private system.
      (4)   The Town Council shall not approve the use of any private sewer system until written assurance and approval of the system has been received from the County Health Department and/or the State Board of Health, as may be applicable.
   (E)   The Plan Commission shall not consider final approval of a plat until advised by the Town Council that all applicable approvals have been received and are on file. Copies of the approvals shall be made a part of the Plan Commission's file on the plat.
