§ 150.050  INSPECTION.
   (A)   (1)   All construction shall be subject to periodic inspections by the Building Commissioner and the Building Inspector irrespective of whether a building permit has been or is required to be obtained.
      (2)   The Building Commissioner and/or the Building Inspector may at any reasonable time go in, upon, around or about the premises where any structure subject to the provisions of this chapter or to the rules of the Fire Prevention and Building Safety Commission is located for the purposes of inspection and investigation of the structure. The inspection and investigation may be made before and/or after construction on the project is completed for the purposes of determining whether the structure meets building standards and procedures and ascertaining whether the construction and procedures have been accomplished in a manner consistent with this chapter and the rules of the Fire Prevention And Building Safety Commission.
      (3)   For due cause as determined by a received complaint from the Town Council, Town Planning Commission, Town Board of Zoning Appeals, renter, neighbor or obvious sight violation, the Building Inspector is authorized and directed to make inspections to determine the condition of dwellings, dwelling units and premises inspections located within the town's zoning district, in order that they may perform their duty of safeguarding the health and safety of the occupants of the dwelling and of the general public. For the purpose of making the inspections, the Building Inspector is authorized to enter, examine and survey, at proper times after a ten-day notice, all dwellings, dwelling units and rooming units or the person in charge thereof shall give the Building Inspector access to the dwelling units, dwellings or rooming units and their premises, at proper times after due notice, for the purpose of the inspection, examination and survey. Every occupant of a dwelling or dwelling unit shall give the owner thereof or his or her agent or employee, access to any part of the dwelling or dwelling unit or its premises, at all reasonable times for the purpose of making the repairs or alterations as are necessary to effect compliance with the provisions of this section.
   (B)   The Building Commissioner, the Building Inspector and the Fire Department shall work cooperatively to conduct inspections and investigations to promote compliance with fire safety laws (the Fire Department has independent authority to conduct inspections and take enforcement actions under I.C. 36-8-17).
