(A) There is hereby created a Department of Storm Water Management which shall be responsible to the Town Council for the operation of the town's storm water system.
(B) The Council shall have all powers necessary for the custody, management and operation of the utility under the provision of I.C. 36-9-23-3 et seq., and amendments thereto.
(C) The Council shall appoint personnel to the utility as deemed necessary.
(D) There is hereby established a Storm Water Fund into which the Clerk-Treasurer shall pay over funds raised by taxes or contributions by developers and property owners. The funds thus paid into the Fund shall be appropriated as provided by the Indiana Code and the Town Council.
