§ 95.080  ORDER TO REMOVE OR PRUNE.
   (A)   Upon the order of the Town Council, notice in writing of order to remove and/or trim any tree or shrub, wherever located, deemed a hazard to public safety by the Street Superintendent, or his or her designee, shall be served upon any real estate owner who is a resident of the town by leaving a correct copy thereof at the owner's last known place of residence. If the owner is not a resident of the town, then notice may be served by sending a correct copy thereof by the United States certified mail, addressed to the owner at his or her last known mailing address with a return receipt requested. If the residence of the owner cannot be ascertained, then the notice may be served by publishing the notice once each week for two consecutive weeks in a newspaper of general circulation in the town.
   (B)   The notice shall describe the:
      (1)   Kind of tree, shrub, plant or part thereof in violation of this chapter;
      (2)   Sections of this chapter for which the property owner is in violation;
      (3)   Address by legal description or street address of the location or premises of the trees or shrubs;
      (4)   Actions that the property owner may undertake to abate the violation; and
      (5)   Period specified to abate the violation.
   (C)   The period specified in the notice shall be deemed to commence on the day following the date notice was sent or first published. The removals or trimming required shall be completed within the period specified in the notice given by the town to the owners.
