§ 95.053  CONSTRUCTION AND EXCAVATION.
   (A)   No person shall excavate any ditches, tunnels or trenches; nor lay any drive; install underground utilities; or store any soil, stone, cement, or other substance within a ten-foot radius of any public tree without the permission of the Street Superintendent through a tree care permit, at which time mandatory protection measures for the tree(s) may be designated.
   (B)   All trees on any street or other publicly owned property near any excavation or construction of any building, structure or street work shall be guarded whenever possible with a fence, frame or box, not less than four feet high and eight feet square and all building material, dirt or other debris shall be kept outside the barrier. Where heavy equipment will pass repeatedly over the tree's critical root zone, particularly in wet conditions, a temporary layer of shredded bark or wood chips shall be placed and maintained on the ground.
