§ 71.15  OFF-ROAD VEHICLES AND SNOWMOBILES.
   (A)   Definitions. For the purpose of this section, an OFF-ROAD VEHICLE refers to an off-road vehicle or a snowmobile as defined in I.C. 14-16-1-7.
   (B)   In order to operate an off-road vehicle on any public street, alley, or road within the limits of the town, an operator must comply with all of the provisions set out in I.C. 14-16-1-1 et seq. and the town hereby adopts said provisions as its rules and regulations concerning the use of "off-road vehicles" within the town. Further the town requires as follows.
      (1)   Every year in addition to registering the vehicle in compliance with Indiana Code with the Indiana Department, an owner and operator must register the off-road vehicle with the town through the Culver Police Department. There shall be no registration fee paid to Culver.
      (2)   The owner of an off-road vehicle shall attach decals issued by the State of Indiana and the town on all vehicles and shall maintain the decals in legible condition and displayed for the entire period of registration.
   (C)   An individual may not operate a vehicle required to be registered under this chapter upon a public highway, street, or rights-of-way thereof or on any public or private parking lot not specifically designated for use of vehicles except under the conditions as specified in I.C. 14-16-1-1 et seq.
   (D)   A law enforcement officer of the town may authorize use of the vehicle on the public highways, streets, and rights-of-way within the officer's jurisdiction during emergencies when conventional motor vehicles cannot be used for transportation due to snow or other extreme highway conditions.
   (E)   A vehicle may be operated on a street or highway for a special event of limited duration conducted according to a prearranged schedule only under permit from the town. The event may be conducted on the frozen surface of public waters only under permit from the Department.
   (F)   An off-road vehicle may only be operated in accordance with the regulations and provisions set out in I.C. 14-16-1-1 et seq. An individual shall not operate an off-road vehicle under conditions prohibited by I.C. 14-16-1-1 et seq.
   (G)   Anyone violating any of the provisions of this Ordinance shall be subject to a fine of $100. If a person is cited for a violation of this subchapter more than three times, the registration shall be revoked and the off-road vehicle shall no longer be allowed to operate within the limits of the town.
