§ 92.02  SIDEWALK USAGE POLICIES; DRIVEWAYS AND RIGHTS-OF-WAY.
   (A)   The following are rules and regulations concerning driveways and rights-of-way and sidewalk usage policies:
      (1)   Sidewalks are for pedestrian use only.
      (2)   A person, corporation, partnership, individual proprietorship, or unincorporated association may not block or impede the flow of traffic on a sidewalk.  (See § 92.01).
      (3)   A permit is required from the town hall before any alterations, excavations, or removals to town sidewalks are permitted.
      (4)   In the event that a person, corporation, partnership, individual proprietorship, or unincorporated association alters, excavates, or removes a portion of a sidewalk, the replacement sidewalks must conform to the following specifications:
         (a)   Transitional or cross slope of sidewalks may not exceed 1/4  per foot.
         (b)   Maximum slope of sidewalk in the direction of travel shall not exceed 1 fall or rise per 12 of horizontal space (12:1) unless otherwise approved by the Town Council.
         (c)   Path of the sidewalk must be concrete or other hard surface approved by the Town Council.
      (5)   If a sidewalk is being altered, excavated, or removed for purposes of adding a driveway, in addition to the above requirements, the driveway shall conform to the following specifications:
         (a)   Path of the sidewalk may be asphalt instead of concrete for the portion of the driveway only.
         (b)   The sidewalk must be able to withstand vehicular traffic.
         (c)   Any damage to the sidewalk due to vehicular traffic shall be the property owner's responsibility to repair within 90 days.
      (6)   A sidewalks must be replaced in its previous location unless a change in layout is approved by the Town Council.
      (7)   Permit applications shall be available at the town hall.  All applications must be submitted, reviewed, and approved before any work is allowed at the site.
      (8)   A fee of $100 shall be submitted with a permit application.
      (9)   A permit without all of the above information and fee shall not be accepted by the town hall.
      (10)   The permits shall be approved or rejected by the Street Superintendent.  If the permit is rejected, the reasons for the rejection shall be listed along with the notification to applicant of the rejection.
      (11)   All deviations or variances from the aforementioned rules and regulations may only be approved by the Town Council.
      (12)   A permit shall be valid for a period of 90 days from the date of approval.  All work must be completed within the 90 days covered by the permit.
   (B)   Any person, firm, or corporation who violates any provision of this section shall be subject to penalties as set forth in § 10.99.
