§ 91.03 CITATION AND NOTICE TO ABATE; CONTENTS.
   (A)   Citation and notice.  Whenever the Chief of Police, a member of the town Police Department, Street Commissioner, or a person designated by resolution of the Town Council designee finds that a nuisance exists, they shall cause to be served upon the occupant of the property and the property owner (if different from the occupant), as shown by the record of the County Auditor, a written citation and notice to abate the nuisance.  The notice shall be sent by personal service or by certified mail to the occupant of the property and the property owner (if different from the occupant).
   (B)   Contents of citation and notice to abate. The citation and notice to abate shall contain the following:
      (1)   A description of what constitutes the nuisance and reference to the specific section of this chapter on which the citation is based;
      (2)   The name of the owner or occupant to whom the citation is directed;
      (3)   The location of the nuisance;
      (4)   A statement of the act or acts necessary to abate the nuisance;
      (5)   A reasonable time within which to complete the abatement;
      (6)   A statement that if the nuisance is not abated as directed and no request for hearing is made within the time prescribed, the town may abate it and assess the costs against the violator. Additionally, the person to whom the citation is directed shall be informed that the violator will be responsible for all fines specified by this chapter and all attorney fees and other expenses incurred by the town in prosecuting the violation of this chapter.
